দুর্নীতি দমন কমিশনের (দুদক) করা মামলায় সাজার রায়ের বিরুদ্ধে বিএনপির ভাইস চেয়ারম্যান মীর মোহাম্মদ নাসির উদ্দিন ও তাঁর ছেলে বিএনপির কেন্দ্রীয় সহ-সাংগঠনিক সম্পাদক মীর মোহাম্মদ হেলাল উদ্দিনের লিভ টু আপিল ( আপিলের অনুমতি চেয়ে আবেদন ) মঞ্জুর করেছেন আপিল বিভাগ। একই সঙ্গে মীর নাসিরের ১৩ বছরের সাজা এবং মীর হেলালের তিন বছরের সাজা স্থগিত করা হয়েছে।
রোববার আপিল বিভাগের জ্যেষ্ঠ বিচারপতি মো. আশফাকুল ইসলামের নেতৃত্বাধীন তিন সদস্যের বেঞ্চ এ আদেশ দেন। হাইকোর্টের রায়ের বিরুদ্ধে মীর নাসির ও মীর হেলালের পৃথক লিভ টু আপিল মঞ্জুর করেই এই আদেশ দেওয়া হয়।
আদালতে মীর নাসির ও মীর হেলালের পক্ষে শুনানি করেন জ্যেষ্ঠ আইনজীবী রাগীব রউফ চৌধুরী, আর দুর্নীতি দমন কমিশনের (দুদক) পক্ষে শুনানিতে ছিলেন আইনজীবী আসিফ হাসান।
আদেশের পর জ্যেষ্ঠ আইনজীবী রাগীব রউফ চৌধুরী দেশীবার্তা কে জানান, মীর নাসিরের ১৩ বছর এবং মীর হেলালের তিন বছরের সাজা স্থগিত করা হয়েছে। তাঁদের করা লিভ টু আপিল মঞ্জুর করে আদেশ দিয়েছেন আপিল বিভাগ। আনুষঙ্গিক প্রক্রিয়া শেষে আপিলের ওপর পূর্ণাঙ্গ শুনানি অনুষ্ঠিত হবে।
অবৈধ সম্পদ অর্জন ও সম্পদের তথ্য গোপনের অভিযোগে ২০০৭ সালের ৬ মার্চ দুর্নীতি দমন কমিশন (দুদক) মীর নাসির ও তাঁর ছেলে মীর হেলালের বিরুদ্ধে গুলশান থানায় মামলা করে। একই বছরের ৪ জুলাই বিশেষ জজ আদালত মীর নাসিরকে ১৩ বছর এবং মীর হেলালকে তিন বছরের কারাদণ্ড দেন।
রায়ের বিরুদ্ধে তাঁরা হাইকোর্টে পৃথক আপিল করেন। ২০১০ সালের ১০ আগস্ট হাইকোর্ট মীর নাসিরের সাজা বাতিল করেন, আর একই বছরের ২ আগস্ট মীর হেলালের ক্ষেত্রেও একই আদেশ দেন। তবে, দুদক হাইকোর্টের রায় বাতিল চেয়ে আপিল করে। শুনানি শেষে ২০১৪ সালের ৩ জুলাই আপিল বিভাগ হাইকোর্টের রায় বাতিল করে বিচারিক আদালতের রায়ের বিরুদ্ধে করা বাবা-ছেলের পৃথক আপিল পুনরায় শুনানির জন্য হাইকোর্টে পাঠান।
পুনরায় শুনানির পর, ২০১৯ সালের ১৯ নভেম্বর হাইকোর্ট মীর নাসিরের ১৩ বছরের ও মীর হেলালের তিন বছরের সাজা বহাল রাখেন। এরপর ২০২০ সালে তাঁরা পৃথক লিভ টু আপিল করেন। শুনানি শেষে আপিল বিভাগ লিভ টু আপিল মঞ্জুর করে তাঁদের সাজা স্থগিতের আদেশ দেন।
